Rape is a crime that affects everyone. The act harms men, women and the community. Women victims of rape suffered physical and emotional abuse. To date tend to suffer from loss of trust low self esteem affair of man depression in many other symptoms due to psychological trauma. Spouses’ partner’s families and friends suffer with the victims. The relationship with victim can’t change drastically after a rape. Men can also be victims of rape. The community also suffers. It cost a large sum of money to investigate arrest and prosecute a rape. It also affects the quality of living in the community by putting fear in the residents.
There are numerous different types of rape. Anger rape is when the rapist uses sex to release pent up rage and anger. The assault is brutally violent. This assault is usually impulsive and spontaneous not premeditated. With power rape, the rapist wants control over the victim. Physical aggression is used to overpower and subdue the victim.
Or render a helpless. The victim may be tied up held down by force or rendered helpless.
Sadistic Rape is when anger and power become a sexual stimulant to the rapist. He gets pleasure from the victim’s pain and suffering. Date rape is when you’re raped by someone you know; this is also known as Acquaintances rape. Teens and young women are vulnerable to this type of crime. This crime occurs when the perpetrator intends to have sex and the victim resists, he then uses more aggressive methods to get his way.
Spousal rape is also an issue we’re facing today. Until recently it was legal in most states to force your spouse into sex. With spousal rape, the man needs to reinsert his manhood by forcing sex on his wife. Stranger Rape is rape by a complete stranger. This crime happens less than date rape. The crime of gang rape is the act of multiple offenders taking turns with a victim or a group holds the victim down for others to have sex with.
I think the task of investigating sexual offenses presents several more hurdles than normal investigations due to the nature of the crime. The victims, who have already been victimized, are embarrassed and feel that the crime is somehow their fault. They are embarrassed to recount the story to officers, thereby re-living a traumatic experience. Victims often do not report the crimes until later, and have since left the scene of the attack, or have showered and changed clothes, thereby destroying evidence. When children are involved, you also must factor in their age and their knowing how to distinguish right from wrong, and a truth from a lie. Children also sometimes have parental influence in reporting the crimes, and you must determine if there is some other parental influence involved. Sometimes One spouse reports that the other ex-spouse has been touching their child inappropriately. The ulterior motive being that a crime may or may not have been committed, but the mother / father is looking for something to hang their hat on in a custody battle.
Another one of the hurdles encountered is whether the attack was consensual or not and the effect that alcohol, drugs, or knock-out pills if used play a part. There are times when during the crime the victim may have been drinking alcoholic beverages or taking illegal narcotics, or may have had something unknowingly slipped in their drink, so their recollection of the events before, during, and after may not be very clear.
As far as laws that affect rape investigations, they are of course guided by the Miranda (during interrogation of suspects) and the need for search warrants (should the property owner not give permission to search a residence for evidence). They are also often required to get search warrants for computers in regards to child pornography investigations.
